Terms and Conditions
The aim of these terms and conditions is to form a clear understanding between myself and my
clients
1. Definitions
"The Photographer" means Paul Maple (Wedding Eye).
"The Client" means any person, body of persons, firm or Company with whom the Photographer enters into a contract for the sale of goods or provision of services by the
Photographer.
"the Order" means any instruction by on behalf of the client for work undertaken by the photographer."Material" means the work ordered by the customer. eg digital photographs in electronic form or prints
etc.
2. Any work of any description undertaken by the Photographer pursuant to an Order shall be subject to these Terms and
Conditions.
3. Price - The price will be agreed between the client and the photographer prior to the order being
placed.
4. Booking Deposit - A deposit of £200.00 is required at the time of booking, together with a signed contract. Dates are reserved only when this deposit is paid by cash or
cheque.
5. Full payment - 60 days prior to the wedding date the Photographer will present an invoice which the client shall pay in within 30 days.
6. Cancellation - At the photographer's discretion, if the client cancels the coverage 6 months priory to the wedding date the client will receive 50% of the deposit as a refund - 3 months proir to the wedding date or less the deposit will not be
refunded.
7. Copyright - The 1998 Copyright, Designs, and Patents Act assigns copyright to Paul Maple. However, all images belong to the commissioning client and you are free to copy them and re-print them as much as you wish. I reserve the right to use any images captured for publicity purposes.
8. The Photographer shall not be liable to the Client for any failure, in whole or in part, to fulfil his obligations under an Order where failure arises as a result of an event or circumstances beyond his control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. This being said the photographer will make best efforts to fulfil the
order.
9. Liability - Except as may be implied by law and except in the case of death or personal injury where the Client is dealing as a consumer, in the event of any breach of these Terms and Conditions by the photographer the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and we shall under no circumstances be liable for any indirect, incidental or consequential damages
10. Force Majeure - The photographer will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond our control.
11. No Waiver - Our failure to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Client in performance or compliance with any of these Terms and Conditions.
12. Severability - In the event that any or any part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
13. These Terms and Condition shall be construed in accordance with English Law.
